Restrictions & Covenants

These restrictions and covenants run with the land and are filed in the Real Property Records of Edwards County, Texas, referencing 8,839.55 acres recorded in Volume 461, Pg. 408-420. Summary below — refer to the recorded instrument for the controlling language.

  1. 1.Covenants run with the land

    These covenants shall run with the land and shall be binding on the Purchaser and all persons claiming under them. Filed in the Real Property Records of Edwards County, Texas referencing 8,839.55 acres recorded in Volume 461, Pg. 408-420.

  2. 2.Hunting

    Hunting of all kinds, whether on foot or by vehicle, is prohibited on or from roads in the Ranch. No commercial hunting, seasonal leases, or day-lease hunting. Hunting is permitted by landowners and their guests only.

  3. 3.Commercial use

    The property shall not be used for any commercial, short-term rental, or manufacturing purposes.

  4. 4.Grazing lease

    A grazing lease exists on the property, subordinate to any third-party lender deed of trust lien. Livestock may be present, and existing water sources may be used for that livestock. A purchaser may cancel the lease on their tract by constructing adequate fencing to local standards and giving the lessee at least 30 days written notice. Removing or altering existing fences also requires 30 days notice to the lessee.

  5. 5.No dumping or abandoned vehicles

    No automobile, truck, trailer, or other vehicle shall be abandoned on the property, and no dumping or placing of unsightly objects of any kind is permitted.

  6. 6.Setbacks

    No structure of any kind (including hunting blinds and deer feeders) within 100 feet of any property line. All fencing must be set back 30 feet from the centerline of all main access roads.

  7. 7.Nuisance and lawful use

    No noxious or offensive activity, and nothing that constitutes an annoyance or nuisance to any adjoining tract. No illegal activity; all use must comply with federal, state, county, and other applicable regulations.

  8. 8.Sewage

    Discharge of sewage from an RV, travel trailer, home, or cabin is strictly prohibited unless discharged into a permitted septic system (OSSF) installed by a licensed installer.

  9. 9.Residences and RVs

    Not more than one residence per tract; no communal residences. RVs and travel trailers may not be used as primary residences but are allowed for temporary use, subject to setback requirements.

  10. 10.Swine

    Commercial swine operations are strictly prohibited.

  11. 11.Water lines and wells

    Purchasers agree not to impede flow in existing water lines, tanks, or troughs, and grant ingress/egress for maintenance of those improvements and wells. Only purchasers who own an interest in an existing well have the right to use its water unless granted by the well owners.

  12. 12.Subdivision

    No tract may be subdivided without the express written consent of the Seller.

  13. 13.Floodplain notice

    The property may be located in a 100-year floodplain and may be susceptible to flooding. FEMA maintains a searchable flood map at no cost. Most insurance policies do not cover flood losses; purchasers should seek appropriate coverage.

  14. 14.Access road

    Seller has constructed or will construct a graded caliche/gravel access road adequate for single-vehicle access, with a non-exclusive easement for ingress and egress. Caliche or other material may be removed from tracts to construct this road without compensation.

  15. 15.Maintenance fee

    A maintenance fee of $5.00 per acre per year (capped at $500) funds entrances, roads, community wells, water lines, and storage tanks. Tracts fronting the county road pay $3.00 per acre per year (capped at $500). Unpaid charges after 60 days become a lien against the tract.

  16. 16.Property owners association

    Seller may, at its discretion, call a meeting of tract owners to organize a Property Owners Association, one vote per tract. Upon organization, road maintenance funds and collection authority transfer to the association.

  17. 17.Water wells

    Purchasers agree to comply with all applicable local water district regulations regarding the drilling of a new water well.

  18. 18.Deviations

    No deviation of any kind from these restrictions unless permission is granted in writing by the Seller.
